Acceptance of your booking order

Please note that completion of the online booking and ordering checkout process does not constitute our acceptance of your order. We will notify you by email as soon as possible to acknowledge that we have received your booking/order and are processing it. Our acceptance of your booking/order will take place only when we have taken payment from you and have dispatched the services and products that you ordered from us. Prior to dispatch, Optimal Movement Ltd has the right to decline a booking or order for any reason.

The duration of our contract with you will start from when you receive the booking or shipping confirmation email and last until the last day of your right to cancel the services and products.

If we cannot supply you with the service or product you ordered, we will contact you either via telephone or email to discuss your order with you.

If we are unable to supply your order to due higher than expected shipping costs, we will contact you to make you aware of this at the earliest opportunity and give you the option to pay a surcharge or to cancel the order.

If the fulfilment of an order (or any aspect of it) would be illegal or unlawful, including by reason of breach of export controls or sanctions rules, Optimal Movement Ltd has the right to stop or cease to fulfil the order at any time, including after despatch of services and products and/or notification to you that the order has been received and is being processed.  You acknowledge that Optimal Movement Ltd shall incur no liability in such circumstances.

Payment 

During the checkout process, you will be asked to enter your payment details. By completing your payment details you confirm that the credit or debit card being used is registered to you. All fields indicated as compulsory must be completed. Please note, our payment providers will hold information related to your order using a secure encrypted system.

All card payments are subject to authorisation by your card issuer. We take full payment immediately for all services and products.

All services and products ordered will remain the property of Optimal Movement Ltd until we have delivered the services and products to the address specified by you during the checkout process. If your payment is not received and you have already received the services and products you ordered from us, you must pay for or return those services and products to us in accordance with our reasonable return instructions and in the same condition that you received them at your own expense. If you do not do this within 30 days of the date on which we cancel your order, we may collect or arrange for collection of the services and products at your expense. We reserve the right to charge you for any and all damage to (or other adverse interference with) any services and products that are the subject of an unpaid order.

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

    • You place the order for your services and products on the Website by pressing the ‘Book Now’ or ‘Pay Now’ button at the end of the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website
    • You’ll need JavaScript enabled on your computer to buy services and products and check out. Please enable JavaScript in your browser, then refresh your browser to continue.
    • We will send you an order confirmation email detailing the services and products you have ordered. This is not an order acceptance
    • When your product is shipped from us we will send you a shipping confirmation email
    • Order acceptance and the completion of the contract between you and us will take place on the dispatch to you of the Services and products ordered unless we have notified you that we do not accept your order, or you have cancelled it in accordance with the instructions in Change or cancel an order
    • Your credit/debit card will be charged at the point of sale
    • If the product is being delivered direct to you from a supplier you may be charged at any point between confirmation of your order and despatch. The exact timing of this will vary according to supplier and the product you’re ordering

Delivery Information

Delivery (including delivery charges and timescales) 

Delivery charges and timescales vary depending on the type of services and products ordered, the service you select and the delivery address. Delivery charges will be calculated once in the shopping basket. Due to the nature of the goods, we cannot provide an estimate of delivery costs prior to this. Please note that certain services and products and services may be subject to alternative delivery charges, restrictions and/or timescales.

Delivery will be to the address specified in your order. If a signature is required for your order and no one is available to provide a signature at the time of delivery, a note will be left to advise whether your order has been left in a safe place e.g. with a neighbour, or returned to depot. All risk in the services and products you order (including risk of loss and/or damage to the services and products) shall pass to you when they are delivered to the delivery address specified in your order.

We shall be under no liability for any delay or failure to deliver services and products if the delay or failure is wholly or partly caused by circumstances beyond our control. We will not be liable for loss, damage, delay, shortage, misdelivery, non-delivery, misinformation, or failure to provide information in connection with your shipment caused by events we cannot control, including but not limited to acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including customs and health officials) with actual or apparent authority.

International Delivery

Due to customs, legal, regulatory and certain practical restrictions applicable to orders placed for international delivery, some of our services and products may not be available for delivery to certain destinations. Optimal Movement Ltd reserves the right to define what can and cannot be delivered to which destination.

Optimal Movement Ltd services and products are sold on a delivery duty unpaid basis. The recipient may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation and customers are required to check these details before placing an order for international delivery. Where applicable, it will be your sole responsibility to comply with any export controls or sanctions rules applicable to goods supplied to you.

Delays

Where the supply of your order is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

We will not be liable for loss, damage, delay, shortage, misdelivery, non-delivery, misinformation, or failure to provide information in connection with your shipment caused by events we cannot control, including but not limited to acts of God, perils of the air, weather conditions, mechanical delays, acts of public enemies, war, strikes, civil commotions, or acts or omissions of public authorities (including customs and health officials) with actual or apparent authority.

Changes to your order

Any changes to your order must be made within 30 minutes of placing your order otherwise we may be unable to make the amendments. If you amend or change your order, there may be changes to your delivery estimate or to the price of the item, you will be informed of any changes when you amend your order. To change your order, simply contact our Customer Care.

Your right to cancel

If you are contracting with us as a consumer online or by phone, you have the right to cancel (under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (the “Regulations”)), all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods or services you ordered.

Any paid delivery charge will be included in your refund once we have received all (not part) of your order to the specified address below. Please note that the delivery charge refund will be to the value of standard delivery.

Unfortunately, some items are non-cancelable and non-refundable. Anything that’s made to your specific requirements (ie: outside of standard customisation options offered by the seller to all customers), is personalised or otherwise can’t be resold due to a bespoke element cannot be cancelled or refunded.

Exercising your right to cancel

To exercise your right of cancellation, you must inform us of your decision to cancel the contract in writing within 14 calendar days after the day on which you receive the goods you ordered, which you can do by contacting us.

You must take reasonable care of the goods while in your possession. You shall send back any goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from the contract to us. The deadline is met if you send back any goods before the period of 14 days has expired. You will have to bear the direct cost of returning any goods to us.

Services and products should be returned in or with their original packaging. You are only liable for any diminished value of the goods resulting from the unnecessary handling of the goods in excess of what is necessary to establish the nature, characteristics and functioning of the goods.

We will process your refund with 14 days of receipt of the services and products to the address given to you when you cancelled your order.

This is not intended to be a full statement of all of your rights under the Regulations. Full details of your rights under the Regulations are available in the UK from your local Citizens’ Advice Bureau or your Local Authority’s Trading Standards Office.

Our Refund Policy

Our refund policy is offered on all goods provided that you have requested a return within 30 days of receipt. All items must be returned with a completed returns form within 10 business days of requesting a return to avoid a late restocking fee of 20%. Once we have received your product back we can then begin to process your refund.  Please be aware, however, that we are unable to refund shipping costs as we are unable to claim back the costs we incur as a result of shipping.

You shall be refunded only the subtotal providing your item is still in new/as sold/re-saleable condition, has not been used and is still in its original packaging with all parts included.  All items are thoroughly inspected upon return, and if it is judged the item is not in new/original condition (as was shipped), is dirty/has been used, up to a 50% restocking fee may be applied to the refund amount.

Unfortunately, some items are non-cancelable and non-refundable. Anything that is made to your specific requirements (ie: outside of standard customisation options offered by the seller to all customers), is personalised or otherwise cannot be resold due to a bespoke element cannot be cancelled or refunded.

Services and products lost or damaged in transit

If you choose to return any services and products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded or tracked delivery service. If returned services and products are lost or damaged in transit, we reserve the right to charge you (or not to process a refund) for any such loss or damage.

Damaged or incorrectly supplied services and products

You should check all services and products you receive against your order. If the services and products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply and you must inform us (by phone or email only) within 30 days. Please note, we will ask for evidence of damage or error in supply in order to offer you a replacement product or refund. You must return the services and products to us as soon as possible after informing us that the services and products are damaged or have been incorrectly supplied. We may offer you a replacement product and any refunds that are processed will be processed in the same way that the order was placed.

Your Statutory Rights

In addition to our returns policy, you also have statutory rights. In addition to the cancellation rights noted above, these include that the goods you purchase are of satisfactory quality, fit for purpose and as described. Within 30 days of the delivery, you may exercise the right to a refund if the product purchased is not of satisfactory quality, fit for purpose or as described. After the 30-day period, but within six months of the date of delivery and where the product is faulty, you are entitled to a repair or replacement or where that is not possible, or the repair/ replacement does not resolve the fault, a refund. After six months of the date of delivery, similar rights exist, but only if you can prove that the fault was present at the point of delivery.

Discount Codes

Coupons, discounts and promotional discount codes offered by Optimal Movement Ltd are valid only for use as part of a purchase made the Website, unless otherwise stated. Such promotional discounts are not valid for use as part of a purchase for telephone orders. Optimal Movement Ltd reserves the right to refuse discount codes. If you have found your discount code via a third party website, please be aware that this code will not be accepted. We do not distribute discount codes via third party websites.

Product Descriptions
